The driver had a blood-alcohol level of 0.21, which is almost three times the legal limit of 0.08 in Utah. Injury attorneys in Utah warn that not only is it illegal, but it is not safe to drive while intoxicated.

The driver, Erik H. Yazzie was charged with automobile homicide, a second-degree felony; DUI, a third-degree felony; theft by receiving stolen property, a class A misdemeanor; and improper lane travel, a class C misdemeanor.
